Welcome to jwhiteco.com (the “Website”). This Terms of Use Agreement (the “Agreement”) is made and entered into by and between you and J.White (Co) LLC (the “Company”, “us”, “we”, or “our”). This Agreement governs your use of and access to the Website and any products, materials, and services provided by or on the Website (collectively, the “Services”).

We reserve the right to modify this Agreement at any time. Changes will be effective immediately for new users and upon reasonable notice for existing users. Your continued use of the Services after changes are made constitutes your acceptance of those changes.

Access to the Services

We may modify, withdraw, or discontinue the Services at any time without notice. You may be required to register for an account to access certain features.

Commitment & Responsibility
By purchasing, you acknowledge that results are not guaranteed. Your success depends on your personal effort and implementation of the tools, resources, and strategies provided. We do not offer done-for-you services unless otherwise stated.

Prohibited Uses

You agree not to:

• Violate any applicable laws or regulations

• Send unsolicited communications

• Impersonate others

• Harm minors

• Interfere with others’ use of the Services

• Upload or transmit viruses or other malicious code

• Attempt unauthorized access to the Services

Confidentiality
All personal and business information shared within coaching sessions, programs, or communities will remain confidential. Participants are expected to uphold the confidentiality of other members as well.

Intellectual Property Rights

All intellectual property rights in the Services and its content are owned by the Company or its licensors. You are granted a limited, non-exclusive license to use the Services for business or commercial purposes in accordance with this Agreement.

User Content

You are solely responsible for any content you submit to the Services. By submitting content, you grant the Company a worldwide, royalty-free license to use, reproduce, modify, and distribute that content.

Content Standards

User content must not:

• Violate any laws or rights of others

• Be defamatory, abusive, or otherwise objectionable

• Infringe on intellectual property rights

• Contain false or misleading information

Payment Terms
All payments are due in full at the time of purchase unless a payment plan has been agreed upon. Payment plans will be billed automatically on the agreed-upon schedule. Failed or late payments may result in suspension of services or additional fees.

Refund Policy
All sales are final. No refunds will be issued unless explicitly stated in writing. If you have questions prior to purchasing, please reach out to support@jwhiteco.com.

Cancellation Policy
For any subscriptions or recurring memberships, a 30-day written notice is required for cancellation. Notice must be submitted to support@jwhiteco.com. Early cancellations may still require full payment in accordance with the agreed contract or program terms.

Termination

We may suspend or terminate your access to the Services at any time, for any reason, without notice.

Upon termination of your account or access to the Services:

• Your right to use the Services will immediately cease.

• Any provisions that should survive termination (e.g., intellectual property rights) will remain in effect.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

Indemnification

You agree to indemnify and hold harmless J.White (Co) LLC from any claims arising out of your use of the Services or violation of this Agreement.

Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Washington. Any disputes shall be resolved in state or federal courts located in Spokane County, Washington.

Alternatively, at our sole discretion, disputes may be resolved through binding arbitration under rules set forth by the American Arbitration Association in Spokane County. Arbitration will proceed on an individual basis only; class actions are prohibited.

Miscellaneous

1. Waiver: Failure to enforce any provision shall not constitute a waiver.

2. Severability: If any provision is deemed invalid or unenforceable, remaining provisions will remain in effect.

3. Entire Agreement: This Agreement constitutes the entire agreement between you and J.White (Co) LLC regarding your use of the Services.

4. Assignment: You may not assign your rights under this Agreement without prior written consent from us.
